On May 4, 2010 Mr. Scirocco represented the victim of a motorcycle accident in the Sussex County Superior Court, before the Honorable Edward V. Gannon. His client was a passenger on the motorcycle being operated by her husband when another vehicle made a left-hand turn into their path of traffic. After selecting a jury and giving opening arguments, the case settled for a six-figure amount. The plaintiff, who Mr. Scirocco represented, suffered a fracture to her clavicle or shoulder bone.

Robert Scirocco was recently invited by the American Bar Association Section of Labor and Employment Law to speak to the students of Rutgers Law School.
On April 13, 2010 Mr. Scirocco, along with other notable members of the employment bar, including Richard Mariani, gave various perspectives along their lines of practice to future lawyers. Mr. Scirocco spoke of the practice of law from the perspective of attorneys representing plaintiffs in discrimination and whistle blower cases.
Other speakers spoke on other aspects of the practice, including labor, union representation, and defense of employers.
Law students, along with all others preparing for careers, are obviously very concerned about future employment potential. This evening at the law school gave them an opportunity to determine whether this area of practice would be of interest to them.

RECENT EMPLOYMENT LAW NEWS: We recently filed a lawsuit on behalf of an individual who kept getting ridiculed by management at a trucking company on the basis that he was Jewish. Suit was filed against the company for creating a hostile work environment based on the relentless taunts made against our client.
Upon a motion filed by defense counsel, the Sussex County Superior Court Judge dismissed the claim on the grounds that our client had agreed to arbitrate any employment disputes. We were successful in the Appellate Division to reverse the Judge’s decision and thus we can proceed with the lawsuit against the trucking company. [view]

Highlights At Oratory
Mock Trial: Back On Top As Union County Champs
After a one-year
hiatus, Oratory reached the top of the pack again and was named Union County
Champs. This means a spot in the Central Region Championship; and although they
lost the second round, they hold their heads high with the title of county champs. Here

After three years
of an intense litigation battle, the case of Foote v. Budd Lake Volunteer Fire
Department was recently tried in Federal Court, with the jury finding in favor
of the defendant Fire Company. Mr. Scirocco was the trial attorney for the Fire

For
the last five years Robert Scirocco has coached the Oratory Prep Mock Trial Team.
Oratory Prep is a Catholic School located in Summit, New Jersey. The team in
February 2009 won the annual Mock Trial Competition in Union County. For the
last five years that Robert Scirocco has coached the team, Oratory Prep has won
the county championship four times. The team recently celebrated its victory
with a banquet held at the Rock Spring Country Club in West Orange, New Jersey.

Last January Robert
Scirocco spoke to the NAIW of Northern New Jersey, an organization of insurance
brokers and agents, in Paramus, New Jersey. At this appearance, he discussed
the pitfalls that confront these practitioners. He also presented “Scirocco’s
9 Rules of Broker Coverage and Liability.”
They are as follows:
- If you promise
the customer insurance coverage, get it.
- Ignorance of
available coverage is no defense.
- Disclose unprotected
risks.
- Make a reasonable
investigation into company financial stability.
- Broker may be
responsible for loss to a third party.
- The broker pays
for loss directly and cannot hide behind the insurance company.
- Even if insured
did not read the policy, broker may be responsible.
- Don’t provide
coverage that does not cover the risk.
- The best defense
is always a material misrepresentation by the insured.
