This is Robert Scirocco bringing you today's law bit.
What do you do if your bank accuses you of cashing fraudulent checks, and it
turns out that it was not you but someone who stole your identity? What do you
do if you're then picked up on a warrant for the crime and forced to spend 13
days in the slammer before the bank and the police realize that they made a mistake
and that it wasn't you after all?
This is what the N.J. Supreme Court had to recently decide in light of a suit
that was brought against the bank by the man falsely accused and jailed. The
evidence in fact revealed that the real criminal was only 5 ft 6 inches tall
and that the accused was 6 ft 3.
So what was the legal remedy of the falsely accused? According to the Court...
he had none, because it was simply a mistake on the part of the police and the
bank. So if you find yourself behind bars based on false charges... there may
be nothing you can do about it.
