What is the obligation of a company to accomodate an employee who suffers from medical complications that require that he or she remain out on leave for an extended period of time? The New Jersey Supreme Court recently answered that question in favor of the employer. In a case involving the Atlantic City Hilton, a pregnant employee who suffered complications needed to extend her time out of work for more than the 6 months allowed under the company policy. Once the 6 months were up, she was not able to return and she was fired. The court held that as long as the company has an even-handed policy the termination was valid and she had no right to sue for discrimination.
