Expenses relating to treatment for injuries suffered in an automobile accident are typically covered by the PIP or No Fault provision of a policy.
In the case of Goyco v. Progressive Insurance Company, the New Jersey Supreme Court recently dealt with the issue of whether coverage for injuries sustained when a collision occurred with an automobile while the injured party was operating a low-speed electric scooter are covered under the No Fault provision. Because injuries sustained while operating an electric scooter neither fits into the category of being injured while in an automobile or a pedestrian, the applicable PIP coverage found in the injured party’s insurance policy would not apply. In short, No Fault coverage does not apply for payment of injuries sustained while operating an electric scooter.
