In an opinion issued by the New Jersey Appellate Division in August 2023, Scirocco Law secured a victory for a pair of clients in a premises liability dispute. The case involved a plaintiff who slipped and fell on ice in a parking lot and suffered significant injuries.
The issue addressed by the Appellate Division was whether the defendant property owner and tenant, represented by Scirocco Law, were subject to liability for the slip and fall. The area in question was owned by Scirocco’s clients but was leased to a neighboring property. In a victory for Scirocco’s clients, the Appellate Division ruled that all claims should be dismissed because control of the area in question rested with the neighboring tenant. The Appellate Division thus affirmed the trial court’s ruling granting summary judgement.
